Terms and Conditions

Terms of Use - nursecheck, LLC. - Updated September 27, 2023

1. Acceptance of Terms

By accessing or using our nurse coaching and consulting services, you agree to comply with and be bound by these Terms of Use.

2. Nurse Coaching and Consulting Services

We provide nurse coaching services to assist you in achieving your health and wellness goals, which may include personalized guidance, support, and educational resources related to health and wellness. Our services are intended for informational purposes only and not a substitute for professional medical advice under a doctors care. These services are provided by licensed Registered Nurses in accordance with applicable state and federal law within compact states and District of Columbia. Our registered nurses provide guidance, education, and support to nurses and nursing students. The services offered, aim to enhance professional growth, skills, and knowledge while aligning with ethical and professional standards within the nursing scope of practice. Nursecheck provides coaching and consulting services which include educational content on healthy lifestyle changes (such as diet/exercise, weight reduction, managing stress, smoking cessation, limiting alcohol consumption, increasing vitamins/nutrients for bowel health and other physiological issues that can be solved through the nursing scope of practice), travel nursing, tax laws for travel nursing, changing nursing specialties, time management in healthcare, leadership in healthcare organizations, nursing career advice, and studying/retaining nursing knowledge. Both coaching and consulting services are dealt with separately using agreements outlined below.

3. Coach-Client Relationship

  1. Coach Relationship: Coaches on the Platform are experienced nurses but are not acting as your primary healthcare advisor. The coaching relationship is for guidance and support purposes only through the nursing scope of practice. 
  2. Introduction and Purpose: A nurse coach focuses on guiding and empowering individuals to reach their health and wellness goals through coaching and support. 
  3. Confidentiality and Privacy: We are committed to protecting your privacy and comply with all applicable HIPAA regulations and laws of federal and state governing bodies of compact states within the USA and District of Columbia. Our Privacy Policy outlines how we collect, use, and protect your personal health information. We ask that you provide emergency contacts in case of emergencies notifying the correct authorities in your plan of care. 
  4. Goals and Objectives: Identification of specific health goals in the future (e.g., diet, exercise, stress management) and establishing measurable objectives for each goal.
  5. Client Responsibilities: As a client, you are responsible for your decisions and actions. Coaches do not have control over your choices, and outcomes may vary based on your individual circumstances.
  6. Compensation: Compensation for coaching services shall be agreed upon in advance and outlined in payment of coach-client agreement. 
  7. Cancellation and Rescheduling: Clients are required to provide notice of cancellation or rescheduling at least 24 hours before the scheduled consultation.

4. Consultant-Client Relationship

  1. Consultant Relationship: The nurse consultant on the Platform offers guidance, advice, and information on topics related to travel nursing, changing nursing specialties, time management in healthcare, leadership in healthcare organizations, nursing career advice, studying/retaining nursing knowledge and advocating for the nursing profession to nurses, nursing students and bodies of education.
  2. Consultant's Responsibilities: The consultant shall provide accurate, up-to-date, and reliable information based on their expertise and knowledge in the specified areas of nursing detailed in section 4A.
  3. Client's Responsibilities: The client is responsible for verifying and applying the information provided by the consultant. The consultant's advice should not replace professional healthcare or legal counsel and only speak to within the nursing scope of practice. 
  4. Confidentiality: Both parties agree to maintain the confidentiality of any sensitive or proprietary information shared during the consultation, and not disclose it to third parties without express consent.
  5. Compensation: Compensation for consulting services shall be agreed upon in advance and outlined in a separate agreement or discussed during initial consultation.
  6. Cancellation and Rescheduling: Clients are required to provide notice of cancellation or rescheduling at least 24 hours before the scheduled consultation.
  7. Intellectual Property: Any materials or content provided by the consultant are protected by intellectual property laws and may not be reproduced, distributed, or used without the consultant's permission.
  8. Liability: The consultant is not liable for any outcomes resulting from the client's use of the provided information or advice.

4. User Conduct

You agree to use our Services in compliance with all applicable laws and regulations. You must not:

  1. Violate any third-party rights, including copyrights, trademarks, or privacy rights.
  2. Use our Services to transmit or share any harmful, unlawful, or inappropriate content.
  3. Attempt to interfere with or disrupt our Services or the servers and networks connected to our Services.
  4. Engage in any activity that could harm or compromise the security of our Services or User Accounts.
  5. Always consult with qualified professionals for specific healthcare, tax, or legal concerns.

5. Privacy and Confidentiality

We are committed to protecting your privacy and comply with all applicable HIPAA regulations. Our Privacy Policy outlines how we collect, use, and protect your personal health information. This involves ensuring that any personal health information shared by the coach-client relationship remains confidential and is only disclosed with appropriate authorization or as required by law.

6. Intellectual Property

All content and materials provided on the Platform are owned by or licensed to us. You may not reproduce, distribute, or modify these materials without our written consent. All personal and medical information shared during coaching or consulting sessions will be handled in accordance with applicable privacy laws and regulations.

7. Medical Disclaimer

Our nurse coaches are not medical doctors and do not provide medical advice. Our services are intended to complement, not replace, the advice of your healthcare under providing and operating within the nursing scope of practice. As deemed by the American Nurses Association, nursing is identified as “the “who,” “what,” “where,” “when,” “why,” and “how” of nursing practice:

  • Who: Registered Nurses (RN) comprise the “who” constituency and have been educated, titled, and maintain active licensure to practice nursing.
  • What: Nursing is the protection, promotion, and optimization of health and abilities; prevention of illness and injury; facilitation of healing; alleviation of suffering through the diagnosis and treatment of human response; and advocacy in the care of individuals, families, groups, communities, and populations.
  • Where: Wherever there is a patient in need of care.
  • When: Whenever there is a need for nursing knowledge, compassion, and expertise.
  • Why: The profession exists to achieve the most positive patient outcomes in keeping with nursing’s social contract and obligation to society.

When each of these questions is answered, the complex considerations in scope of practice become clear. In a profession as dynamic as nursing, and with evolving health care demands, changes in scope of practice and overlapping responsibilities are inevitable in our current and future health care system.”

8. Payment and Billing

Details regarding fees for our services are outlined separately in our payment terms. If you choose to purchase these services, you agree to pay all applicable fees and taxes. Payments are refundable which are detailed specifically under each coach-client agreement and consultant-client agreement. 

9. Termination

We reserve the right to terminate or suspend your access to our Services at our discretion, without notice, for any reason, including if you violate these Terms or which the Owner cancels agreement at will.

10. Governing Law

These Terms of Use are governed by the laws of compact licensed states in the USA and District of Columbia under the license of Registered Nurse.

11. Disclaimer 

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, and/or death and dismemberment.

13. Changes to Terms

We may update these Terms from time to time. Any changes will be effective upon posting the updated Terms on our website. It is your responsibility to review these Terms periodically. Continued use of our Services after modifications constitutes acceptance of the updated terms.
